1. Summary of Privacy Policy

This Privacy Policy covers our treatment of information gathered when you are using or accessing the Services. This Privacy Policy also covers our treatment of any information about you that our partners share with us or that we share with our partners.

This app is operated by Timbr Limited (NZBN 9429047803312). By accepting our Term of Use (TOU), you confirm that you are bound by this Privacy Policy. Timbr is committed to protecting your privacy. We follow all procedures that are set out in this document, and it needs to be read and understood together with the TOU. The Privacy Policy applies to customer information we collect through our app and is intended to ensure that you can use the site and contact other members without having to worry about confidentiality issues.

Your privacy is important to us and we want you to clearly understand how information provided by you, or collected during your use of the App, is used to make your visit more enjoyable and bring to you information and opportunities that may be of interest.

By using the App and/or our services, you signify your acceptance of our Privacy Policy and of our TOU. If you do not accept this Privacy Policy or do not accept our TOU, then we kindly ask you to close and uninstall the App.

All references in this Policy to Timbr.nz , “we”, “us”, “our” and similar terms should be interpreted accordingly. Similarly, a reference to “you”, “your”, “yours” or “yourself” in this Privacy Policy is a reference to yourself as a User of this App unless otherwise stated.

2. How We Collect Your Information

Your personal information may be collected or accessed in several ways including:

  • Directly from yourself (whether directly or verbally) when you set up a relationship with us, or you create an account and through any direct or indirect use of our Services; 
  • Generated by us in correspondence etc.;
  • Received by third parties in relation to the services provided by us following your permission, which may be obtained directly from you or indirectly through your actions. In such instances, we will make sure that such third parties are entitled to disclose such information to us.

We may also obtain personal information about you through using our app (timbr.nz).

We have the following lawful basis to process your personal information:

3.1 Provide You with Our Services: The legal basis for processing your personal information is the execution of the service requested from us or the execution of any agreement which you have with us. Your personal information may be used to maintain your account and profile so you will be able to connect with other users on our platform. 

3.2 Consent: In certain instances, we may ask for your consent or specific matters. When your consent is required for the collection, processing and disclosure of personal information, we will ensure that such consent is freely given. We may also ask you for your consent for us to periodically send you marketing material which we think may be suitable for you. Such marketing communications will only be sent to you if you have consented thereto through an ‘Opt-in’. You are hereby informed that, subject to legal or contractual restrictions, you may withdraw your consent to the processing of your personal information. Any communications with respect to such withdrawal or variation of consent shall be in writing and addressed to support@timbr.nz

3.3 Legitimate Interests: We may process your personal information on the basis of our legitimate interests including, to provide you with our service, analysing users' behaviour to improve our services, improve our content, and for administration purposes 

4. Information we collect

The different types of information we collect can include:

4.1. Information voluntarily supplied by you through the creation and completion of your profile, posting on, or engaging in, media such as messaging or chat on the App. This may include, but is not limited, to account credentials, property address, photographs, videos, and similar. 

4.2. Information automatically collected when you visit or use our app, such as your IP address, email address, browser type.

4.3 Information obtained by others through our App. We collect information which would have been provided to us by third party organisations. Such personal information may include contact details, demographic information and internet navigation details. 

4.4. Information provided by Financial institutions or payment processors which may provide us with updates regarding your payment information or payment methods related to your paid account or paid subscription and services. 

5. Our use of information we collect

We use your information to enhance our provision of services to you. Besides that, we also use your information to protect you, other users and the integrity of our app against fraud or as may be required by law.

All the information you fill in about yourself on your profile will be displayed on your profile page. We may remove any inappropriate images, language or words and phrases that don’t contain any information or make sense in the interests of other members and with a view to providing a quality service to every member of the App.

We may internally use personally identifiable information of our users to improve our marketing efforts, to statistically analyse site usage, to improve our content and product offerings as well as to customize our site's content and layout. We believe these uses allow us to improve our site and better tailor your online experience to meet your needs.

We may also use personally identifiable information about you to deliver information to you that, in some cases, is targeted to your interests, such as targeted banners and promotions.

We also use your information for administration purposes and to communicate with you in ways you want to hear from us.

We may contact you regularly by e-mail for customer service purposes as well as to make you aware of specials, new services and opportunities for our customers. We will not contact you via phone or text message without your express consent (opt-in). We use an opt-out standard for all communications other than administrative communication concerning your account.

6. Sharing and Disclosure of Personal information

Your personal information voluntarily provided by yourself is disclosed with other users through your public profile. Kindly note that once you share information publicly on the internet, we will have no control over as to how your information may be used by others. However, we will NOT display any of your personal information such as your real name, email address, full postcode, mobile or landline phone number or IP-address, and they will be kept strictly private and confidential. In any case, when we ask for such information, we make it clear that it is not for display without your express consent.

We may further disclose your personal information with our employees, partners and any other third parties which may require such information to assist us in handling the relationship which we have with you. When we share your personal information with such third parties, we make sure that such parties make use of these data in a manner which ensures safety and security to your personal data. 

We DO NOT sell or rent any personally identifiable information about you to any third party without your specific permission. We may disclose information in aggregate to advertisers and for other marketing and promotional purposes. In these situations, we DO NOT disclose to these entities any information that could be used to personally identify you. 

To maintain a healthy community, we cooperate with all law enforcement inquiries and with all third parties to enforce their intellectual property or other rights.

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our App. We use a credit card processing company to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any other purposes.

We will NOT share your personal information with any third party for marketing purposes without your consent. 

We are required to give information to legal authorities if they have the proper authorization such as a search warrant or court order. Other than a valid request from a legal authority your information is secure on the App. We do our best to ensure that all information held relating to you is kept up-to-date, accurate and complete, but we also rely on you to notify us if your information requires updating or deleting.

Your individual use of the App and your interaction with other members through this site will be kept strictly private.

Subject to your explicit consent, we may from time to time send you emails containing information about the system and site activity, notifications, promotions, as well as promotions by third parties that we feel may be of interest to you. You may unsubscribe from the App’s emails or emails sent by third parties at any time by changing your profile settings or by following the unsubscribe link included in every email sent by the App or by a third-party.

7. Reviewing and Changing Your Information

While we will employ reasonable means to keep your personal information accurate, complete and up to date for its intended use, you must immediately inform us, if and when your personal information changes. 

In so far as your personal information in concerned, you shall have the right to receive confirmation that your personal information is being processed and may request access to the said personal information. You may further request a copy of such information obtained by us - such requests may be made by email to support@timbr.nz. We will provide a copy of such in a structured, commonly used and machine-readable format.

You have the following choices to modify or delete your information from our database: 

  • Send an email to support@timbr.nz
  • Log in with your password and change/delete your profile

If your profile is set for deletion from our database, after making it inactive, please note that we will keep the data associated with it for another three months (approximately ninety calendar days), in case the information is required in connection with the original purpose for which it was collected or otherwise permitted or required by law. In any case your profile will be rendered inactive and it will NOT be shown on the App.

8. Retention of Personal Information

We retain your personal information for as long as it is necessary to provide you with our services as outlined in this Policy, or until your account is deleted, unless a longer retention period is required or otherwise permitted by law. You have the right to obtain from us the erasure of your personal information however this is subject to our legal obligations which may require us to hold your personal information for a specified period. 

9. Objection and Restriction of Personal Information

You have the right to object, on grounds relating to your particular situation, to the processing of your personal data. We shall no longer process your personal data unless we have a compelling legitimate ground for the processing. You have the right to object at any time to the processing of personal data concerning you for direct marketing purposes. 

We further recognise your right to restrict processing of personal data, in which case we will only keep them for the exercise or defence of complaints. 

10. Links to third-party apps

Kindly note that if you access other third-party apps from hyperlinks on our app, we will have no control over the content of those apps. These apps have their own privacy policies for which accept no responsibility or liability. 

11. International Transfer of Personal Data

Where we allow contractors or third parties to process your personal information, we will make sure that there are the proper safeguards in place so as to safeguard your personal information. 

12. Policy changes and updates

The App reserves the right to update this Policy whenever it finds this necessary. Should any changes to the Policy occur, this will be marked via update of the date of last revision of the Policy present at the end of this document.

Kindly note that although we take all such necessary steps to secure your information, we do not promise, and you should not expect, that your personal information will always remain secure.
